About the role

This opportunity will provide you with a uniquely diverse role as the head of the legal team for Drake International Australia.Your responsibilities will include but not be limited to:

  • Contract preparation, review and negotiation including commercial contracts, preferred supplier agreements and leases
  • Interpretations of Awards, IFAs and employment law, providing advice to line managers as required
  • Investigate and provide guidance in relation to litigious actions or claims made against the company or the company’s clients
  • Prepare all legal documentation including statement of claims, witness statements, affidavits etc as required
  • Represent the business at relevant courts, tribunals, and alternative dispute resolution proceedings as required
  • Provide advice, investigate and attend Fair Work Commission (FWC) or Fair Work Ombudsman (FWO) claims/matters internally
  • Liaise with directors, senior executives, managers and payroll personnel to manage exposures and prepare legal responses where applicable
  • Provide advice and guidance to directors, senior executives and line management on legal issues affecting their areas of responsibility
  • Research and provide up to date advice on any employment law questions, regarding various topics including, redundancy, restructures, bullying and harassment, hours of work, contractors, workplace health & safety, salary packages, independent contractors, long service leave, non-compliance etc
  • Ensuring Drake is compliant with all relevant privacy legislation including the Privacy Act 1988 (Cth), as well as any international exposures which may exist
  • Ensuring Drake is compliant with all relevant legislation in regards, to Labour Hire Licencing, Modern Slavery, Sham Contracting, Director Liability, Industrial Manslaughter and Child Safe laws
  • Manage and ensure the businesses intellectual property and trademarks are protected
  • Provide advice and intellectual property and trademarks as well as conduct searches
  • Company secretarial duties including ASIC lodgements and corporate governance advice
  • Provide counsel to management on governmental relationships, important labour negotiations, and the implications of impending legislative changes. May participate in industry and governmental hearings
  • Advise on legal aspects of credit, tax, insurance and property and public relations when required
  • Proactively identify and mitigate any areas or risk
You will have one qualified local in-house lawyer reporting to you and will have a similarly qualified colleague based in our North American office to consult with. In addition, you will have access to specialist external legal advice as required. The role is intended to be broad and diverse and will challenge and stimulate your legal mind. Individuals with the desire and ability to manage highly divergent volumes of work will flourish in this environment. To be considered for this role you will have the following:
  • Bachelors degree in Law (further education is desirable)
  • Admitted as an Australian Lawyer with a full unrestricted practicing license in the State of Victoria
  • Minimum of 7 years experience is desirable
  • Previous experience in an in-house environment is preferred
  • Be able to manage a large and diverse caseload, some of which will fall outside of your own areas of specialisation
  • Understanding of labour hire industry will be highly regarded
  • Proven track record in successfully dealing with complex legal issues
  • Ability to prioritise workload and manage a number of stakeholders expectations
  • Strong organisational skills with ability to work in a complex and fast-paced environment
